Managing Counsel, Privacy

The Mercedes-Benz Research & Development North America (MBRDNA) legal department is seeking an experienced attorney who will focus on our U.S. data privacy program. This is an exciting opportunity to work for a premium global brand on emerging automotive technologies. You will serve as a key privacy advisor to technical teams throughout the product life cycle, among other initiatives. You will also work cross-functionally with internal stakeholders to ensure that our company privacy policies and practices align with the rapidly evolving legal landscape.

This hybrid role requires on-site attendance at least 4 days per week at our San Jose, California, Ann Arbor, Michigan, or Atlanta, Georgia locations. Please do not apply if you are unable to meet this requirement. 

Job Responsibilities:

  • Serve as lead privacy counsel for MBRDNA, providing strategic guidance on domestic and international privacy and data protection laws (e.g., CCPA, CPRA, CPA, VCDPA, GDPR, BIPA) and laws regarding AI and emerging technologies.
  • Enhance MBRDNA’s U.S. privacy program, with a focus on facilitating software development and novel third-party technology engagements.
  • Partner cross-functionally with engineers, IT, legal team members, and other stakeholders to ensure company’s compliance with applicable privacy laws and regulations, and industry best practices.
  • Collaborate with counterparts at domestic and overseas affiliates as needed to align on privacy policies and procedures.
  • Maintain and update MBRDNA’s privacy policies and contractual templates.
  • Draft, review, and negotiate privacy-related contractual terms in commercial agreements.
  • Design and conduct privacy assessments.
  • Create and deliver trainings to employees on privacy policies and procedures.
  • Refine and oversee implementation of security breach response plans.
  • Support external affairs team on analysis of proposed privacy legislation and regulations.
  • Stay current on U.S. and global data privacy, security, and AI legislation, enforcement actions, and industry trends, and adjust internal policies accordingly.
  • Resolve internal and external privacy-related inquiries, and manage outside counsel and privacy vendors.

    Minimum Qualifications:

  • Undergraduate degree and J.D. from an accredited law school.
  • 8+ years of combined data privacy experience in law firm and in-house settings
  • Significant privacy counseling experience at a technology company.
  • Demonstrated mastery of U.S. privacy laws and regulations relevant to our industry, and deep knowledge of GDPR.
  • Proven ability to independently manage complex, cross-functional projects from ideation to implementation in a fast-paced environment.
  • Experience analyzing products to determine compliance with applicable privacy laws, and leading any necessary remediation efforts.
  • Commercial drafting and negotiation experience with privacy and data protection provisions.
  • Ability to provide clear and concise business-minded legal advice.
  • Self-starter, proactive, responsive, and customer oriented.
  • Excellent interpersonal skills and communication skills (written and verbal).
  • A strong desire to solve problems, with a balanced focus on both legal and business concerns.
  • Enthusiasm for positive and respectful relationships internally and externally.
  • Capacity to work independently, as well as part of a team.
  • Admission to and current good standing with the bar of at least one state (California, Michigan, or Georgia preferred).
  • Certified Information Privacy Professional (CIPP)/U.S. credential.

    Preferred Qualifications:

  • Experience in the automotive or autonomous driving industry.
  • Technical background.
  • Experience working at a global technology company.
  • The successful candidate’s starting pay will be determined based on a wide range of factors, including, but not limited to, job-related education, skills, and experience, geographic location, and market conditions. The current salary range for this position is as follows and may be modified in the future: $164,100 - $256,800.
